Are You Eligible To Divorce In New York?

Because New York does not want to create a divorce mill, our legislature set forth the following jurisdictional requirements that must be followed by someone wishing to bring a divorce action in this state. To get divorced in New York, one of the following conditions must exists:

• At least one of the parties has lived in New York for the last two years
• The marriage took place in New York, and one of the parties has lived in New York for the past year
• The grounds for divorce took place in New York, and at least one party has resided in New York for the past year
• The grounds for the divorce took place in New York and both parties reside in New York
